1. Acceptance of Terms

By accessing or using the Pilot in Cloud application (the "App") or website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

2. Description of Service

Pilot in Cloud provides a digital pilot logbook service with features such as cloud backup, image storage, and OCR data extraction. While the service is provided "as is" and "as available," we are committed to maintaining a reliable, secure, and continuously improving experience. We will notify you of any planned maintenance or significant changes that may affect your use of the App.

3. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.

4. User Content

You retain full ownership of all data, files, and images you upload to the App ("User Content"). We do not claim any ownership over your User Content. By uploading User Content, you grant us a strictly limited license to store, process, and display it solely for the purpose of delivering the service to you. We will never use your data beyond what is strictly necessary to operate the App on your behalf.

5. Prohibited Use

You agree not to:

  • Use the App for any illegal purpose.
  • Attempt to reverse engineer or compromise the security of the App.
  • Upload malicious code or content that infringes on others' rights.

6. Limitation of Liability

To the maximum extent permitted by law, Pilot in Cloud and Jordi Marques shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or in connection with your use of the App. The App is a support tool and does not replace official logbooks where required by law unless certified by the relevant authority.

7. Termination

We reserve the right to suspend or terminate your account for conduct that violates these Terms or is harmful to other users. In most cases, we will notify you in advance and give you the opportunity to resolve the issue. Immediate suspension without prior notice may apply only in cases of serious violations, such as illegal activity or a security threat. Upon termination, you will have a reasonable period to export your data.

8. Subscriptions and Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Refunds and Cancellations

You may cancel your subscription at any time. Refunds are handled at the discretion of Paddle in accordance with their terms. Generally, we offer a 14-day money-back guarantee for initial purchases if the service does not meet your expectations.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain and the European Union, including the General Data Protection Regulation (GDPR). As an EU-based service, we are committed to upholding your rights as a data subject, including the right to access, rectify, and request deletion of your personal data at any time.

11. Commercial Use

We do not use your personal or professional data (including flight experience and qualifications) for any commercial purposes. Your data is used solely to provide and improve the functionality of the App. We will never sell, share, or otherwise exploit your data for commercial gain.
